I work with/around a few seriously past-it people, and the feeling is that once they get to a certain age they either think that retirement is a death sentence, or (possibly to avoid retiring) convince themselves that only they know how to do it properly, when in reality they aren't because they're still doing it how they were ten sets of rule changes ago and nobody can tell them otherwise.
The politicisation of the appointments means they should have term limits so they don't have to worry about when they retire, it is just already set.
They would still be appointed by whoever happens to be in charge.
I'm not sure about term limits as such, as if someone is a stand-out jurist or whatever you want to call them, and can still do the job, then that experience shouldn't just be binned due to age/expiration of a term. You do sort of want the best of the best doing the job, but then, you have the way they get appointed and nowadays it doesn't feel like you're getting that in the first place. Maybe they should sit for fixed terms (of say 10 years) and be re-appointable? Of course, it should probably be apolitical but good luck with that.
They are supposed to be apolitical and usually arent appointed until they're 50, so a 20 year term limit should be fine realistically. Supposedly some of the other ancient ones had wanted to retire at points but felt unable to.
They have never and never will be apolitical.
I believe the phrase ‘a stitch in time saves nine’ is literally about the Supreme Court backing FDR because he said he’d make them irrelevant by adding Justices if they didn’t.
