They already have it, they just 'legally' need to get it so they can use it against the other contacts on it in a court of law.
That makes sense if it's not legal for the FBI to access data on a murder suspects phone. I find it very hard to believe that's the case.

And I don't want to be insensitive, but I don't understand the logic of "She's either probably going to die or definitely going to die, so we may as well just let her go."
It's not insensitive. I can't even bear the thought of having to make a decision like that. It's probably not explained fully but I'd imagine it could be arm off leg off and still a really tiny chance of recovery. Absolutely awful stuff.
