If he is, you have to consider the fact that he may actually be an even bigger arse than you already thought he was, since he seems to shag what I assume are mainly prostitutes or porn actresses (not -stars) and the such.

It could also be an explanation for his devil-may-care approach to things, but it's a bit of a hen-or-the-egg situation.

Don't get me wrong, I've little sympathy for him if it's all true, but what an odd move.

I think a lot of rumours have been doing the rounds, presumably with a fair chance of them being substantiated at some point in the near future. Perhaps he's just trying to get out in front of it.

Like Lewis says, I suppose it all comes down to how long he's had it and what he's been up to since he knew.

I think this case (http://news.bbc.co.uk/1/hi/scotland/1223845.stm) was the first I became properly aware of what HIV was. I'm surprised he only got five years as my memory was that he was charged with murder. Whatever the case, it would definitely result in criminal conviction if he has knowingly infected anybody, no doubt with suing for compensation on top.

Murder is a maximum of 25 years (I think that's what a life sentence constitutes in the UK, it changes from country to country) so something like HIV spreading would be third degree at best which means five years makes sense. The idea you could get more for a manslaughter charge running someone down does confuse it somewhat.

There's no such thing as first/second/third degree murder in Scots Law (and I don't think in English/Welsh law either, but not sure). He was just charged with "reckless conduct", which is a pretty broad term for being a dickhead and can carry up to life imprisonment.

Turns out you can also be prosecuted in Scotland if you have sex with somebody without making them fully aware of your condition, even if it doesn't result in transmission. Sadly that doesn't seem to be the case everywhere.
