The seller of the phone said it's on 5.0.2 and I've asked him to make sure not to upgrade before shipping it. Thanks for the tip guys.

I'm so glad I found such a cheap solution, the other used phones of the same generation were all £70+ here ... the one I got has the owner's name engraved at the back but he put a cover in the deal for free which is quite generous.
